By purchasing or obtaining a license to use this software from ANSWERS 2000, USER acquires rights to use this software (subject to all terms of this agreement) on a PC computer system: (a) A USER may use a single copy of the software on a single PC computer system only, for each license purchased/obtained. DISTRIBUTION 1. This software may only be distributed by ANSWERS 2000. No other distribution is permitted. 2. No component part of this software may be distributed individually, disassembled, copied, reverse engineered. No alteration of the software is permitted. 3. This Software may generate HTML and/or JavaScript and/or PHP and/or Perl and/or ASP and/or Activ E-Book Compiler Scripts, explicitly for the purpose of insertion into the USER's web pages or E-Books ("Content Created"). USER is granted a non-exclusive royalty free license to display, modify and create derivative works of any such Content Created, including use in E-Books and Web pages, provided USER's materials have a clear copyright notice, and USER does not encourage third parties to copy or create derivative works of any such Created Content. KEY CODES 1. This product may require a Key Code to be entered into the software, in order to enable the software to function or to enable all functionality. If a Key Code is required for this product, USER agrees: (a) ANSWERS 2000 to the USER will issue a Key Code at the time of purchase. (b) USER will not distribute Key Codes to any other person. (c) USER will not obtain Key Codes from any person or entity other than ANSWERS 2000. (d) USER will not use any technical or other measure to circumvent or disable the Key Code system. (e) No person or entity other than ANSWERS 2000 may charge for (or request donations for) Key Codes. (f) Key Codes are normally only designed to be entered once into the software on each computer. However, in the event of a user reformatting their disk or suffering severe system corruption or switching to a different computer, the same, or a replacement Key Code, may need to be entered into the software. In this event, ANSWERS 2000 will supply 1 replacement Key Code for up to 90 days after the date of purchase, provided the user supplies proof of the amount and date of payment (example: ClickBank receipt number accompanied by date of purchase). ANSWERS 2000 may, at its sole discretion, provide free new or replacement keys to USER after the expiration of the 90 day period. However, ANSWERS 2000 is not obligated to do so. "DIRECT" USE ONLY 1.The license is granted to USER only. The USER may not install the software in any form of environment which allows other parties access to the software, for example via remote- or web-based access, whether for free or in return for any form of consideration. This includes, but is not limited to, providing remote access over a network, over the Internet, or a web-site. WARRANTIES & LIABILITY 1. This software is NOT intended to be used in safety critical environments, such as medical applications, aircraft navigation, industrial applications, etc. The USER agrees not to use the software in any such environment. 2. ANSWERS 2000 limits it warranty to This Software, or when This Software in bundled with other items, the entire package including This Software ("Covered Items"): (a) To the maximum extent permissible under law: Covered Items are provided "as is" and without warranties as to performance of, merchantability or any other warranties whether expressed or implied. (b) To the maximum extent permissible under law: The USER assumes the entire risk of using Covered Items. (c) To the maximum extent permissible under law: In no event will ANSWERS 2000 be liable to any party for any direct, indirect, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of Covered Items, or content created using the Covered Items, even if ANSWERS 2000 is expressly advised of the possibility of such damages. (d) To the maximum extent permissible under law: Even if these limitations are found not to apply, the maximum liability of ANSWERS 2000 will be limited to replacement of the Covered Items or refund of fees paid to ANSWERS 2000 for Covered Items by the USER, according to ANSWERS 2000's preference. (e) To the maximum extent permissible under law: Attempting to modify or reverse engineer the software, etc.; using "warez", "appz", "crackz" or "key generators", etc.; shall be considered to invalidate any warranty. PRODUCT SUPPORT 1. No formal product support is provided, but USERs are encouraged to send questions, comments or suggestions to ANSWERS 2000 by e-mail or by writing. COMMENT 1. USER agrees not to use inappropriate, or off-topic,postings to Internet newsgroups (Usenet) to promote any site owned by ANSWERS 2000, or to promote any site which links to a site owned by ANSWERS 2000. 2. USER agrees not to make inappropriate, or off-topic, postings to Internet newsgroups (Usenet) which make any reference to This Software or ANSWERS 2000 or any of ANSWERS 2000's products or services, in any form of unsolicited e-mail or unsolicited messaging. 3. A Usenet news article shall be considered inappropriate if does not fully comply with the written charter/FAQ of the newsgroup to which it is posted. The USER is responsible for determining the rules of a newsgroup before posting to it. 4. Established Usenet conventions ("Netiquette") prohibit advertising in most Usenet newsgroups. Any disputes arising from matters relating to this agreement and/or This Software shall be exclusively subject to the jurisdiction of the courts of England and Wales. You agree that any legal action against Answers 2000 Limited (or its directors, officers, or employees) relating to this agreement and/or This Software will be brought in the courts of London, England, however the Company reserves right to pursue breach of these terms in any jurisdiction.
